Terms of Service

1. Acceptance of Terms

By accessing or using Butterfluent ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. The Service is operated by Kaizen Dubai ("we", "us", "our"). For enquiries: info@kaizendubai.com.

2. Description of Service

Butterfluent provides an AI-powered language-learning platform offering: subtitle generation from YouTube videos and uploaded media files, subtitle search and download, flashcard deck creation, and vocabulary tools. Features are subject to change with reasonable notice.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for all activity under your account and for keeping your credentials secure. You must be at least 16 years old to use the Service. In EU Member States that allow a lower age of digital consent (minimum 13 under GDPR Article 8), users between 13 and 16 require parental consent. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to: (a) upload or process content you do not own or have rights to; (b) use the Service to infringe copyrights or other intellectual property; (c) attempt to bypass usage limits or security measures; (d) use the Service for any illegal purpose; (e) scrape or automate requests without written permission.

5. Intellectual Property

Butterfluent and its original content, features, and functionality are owned by Kaizen Dubai. You retain ownership of content you upload. By uploading content, you grant us a limited, non-exclusive licence to process it solely for providing the Service. This licence terminates when you delete the content or your account.

6. Free & Paid Plans

Free accounts are subject to usage limits (currently 5 transcriptions and 90 minutes of watch time per month, with projects always available). Pro plans are available at €4.99/month and can be activated from your billing page. Payments are processed by Dodo Payments. All prices are inclusive of applicable taxes unless otherwise stated. We reserve the right to change pricing with 30 days' notice to existing subscribers.

7. Refunds & Cancellations

Cancellation. You may cancel your Pro subscription at any time from your billing page. Cancellation takes effect at the end of your current billing period - you retain full access to all Pro features until then. No further charges will be made after cancellation. We do not offer refunds for the remaining unused portion of a billing period.

EU right of withdrawal. Under EU consumer law (Directive 2011/83/EU), you have a 14-day right of withdrawal from the date of your initial purchase. To exercise this right, contact us at johanshibu007@gmail.com within 14 days of your first payment. Please include your account email and the reason for your request. Refunds under this right will be processed within 14 days of receiving your request, using the same payment method used for the original purchase.

After the 14-day period. Once the 14-day withdrawal period has passed, no refunds are issued. By continuing to use the Service beyond this period, you acknowledge and accept this policy. This does not affect any mandatory consumer rights under applicable law.

Disputes. If you believe a charge was made in error, contact us at johanshibu007@gmail.com before initiating a chargeback with your payment provider. We will work to resolve billing disputes promptly.

8. Data Protection

We process your personal data in accordance with the General Data Protection Regulation (GDPR). Full details about what data we collect, how we use it, and your rights are set out in our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

9. Third-Party Services

The Service uses third-party APIs including Anthropic (translation and language analysis), Groq (transcription), and subtitle databases. We are not responsible for third-party service availability, accuracy, or content. Your use of third-party services is subject to their respective terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ACCURACY OF TRANSCRIPTIONS, TRANSLATIONS, OR SUBTITLE QUALITY. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. THIS DISCLAIMER DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER UNDER EU LAW.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAIZEN DUBAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. THIS LIMITATION DOES NOT EXCLUDE OR LIMIT LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER EU CONSUMER PROTECTION LAW.

12. Governing Law & Jurisdiction

These terms are governed by the laws of the United Arab Emirates. However, if you are an EU/EEA consumer, you retain the protection of mandatory consumer protection laws of your country of residence, and you may bring legal proceedings in the courts of your country of residence. Nothing in these terms limits your rights under EU consumer protection legislation.

For EU consumers: you may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

13. Changes to Terms

We may update these terms from time to time. For material changes, we will notify existing users by email or via a notice on the platform at least 14 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the new terms.
